Without a Power of Attorney and Health Care Directive, a court proceeding for guardianship and conservatorship is likely inescapable. A Power of Attorney allows you to choose who will handle your finances and property should you become incapacitated or cannot make decisions for yourself. A Health Care Directive allows someone to make health care decisions for you, give instructions for terminal care, and state what funeral arrangements you want.
